These terms and conditions govern your use of our services and outline the legal framework for our business relationship.

1. Acceptance of Terms

By accessing or using the services provided by Arabian Reverie Premier Realty ("Company," "we," "our," or "us"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Arabian Reverie Premier Realty.

If you do not agree to these Terms, you must not access or use our services. Your continued use of our services constitutes your acceptance of any modifications to these Terms.

These Terms apply to all users of our services, including but not limited to:

  • Property buyers and sellers
  • Property investors
  • Tenants and landlords
  • Website visitors
  • Newsletter subscribers
  • Service inquirers

By using our services, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. Definitions

For the purposes of these Terms, the following definitions apply:

"Services"

All real estate services provided by Arabian Reverie, including but not limited to property sales, rentals, property management, investment advisory, valuation services, and related consultancy.

"Website"

The Arabian Reverie website located at arabianreverie.com and all associated subdomains, mobile applications, and digital platforms.

"Property"

Any real estate, including but not limited to residential, commercial, industrial properties, land, and any interests therein.

"Transaction"

Any property-related transaction facilitated by Arabian Reverie, including sales, purchases, rentals, leases, and property management agreements.

"Content"

All information, data, text, images, videos, graphics, and other materials available through our services.

"Personal Information"

Any information that can be used to identify you personally, as defined in our Privacy Policy.

3. Our Services

3.1 Real Estate Services

Arabian Reverie provides comprehensive real estate services including:

  • Property sales and purchase facilitation
  • Property rental and leasing services
  • Property management services
  • Investment advisory and consultation
  • Property valuation and appraisal
  • Market analysis and research
  • Legal assistance and documentation support
  • Mortgage and financing assistance

3.2 Service Availability

Our services are primarily available in the United Arab Emirates, with particular focus on Dubai and surrounding emirates. We may extend services to other jurisdictions subject to local licensing and regulatory requirements.

3.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. We will make reasonable efforts to notify users of significant changes that may affect their ongoing transactions.

3.4 Third-Party Services

Our services may include or integrate with third-party services such as mortgage providers, legal firms, inspection services, and property portals. We are not responsible for the availability, accuracy, or reliability of third-party services.

4. User Obligations

4.1 Accurate Information

You agree to provide accurate, current, and complete information when using our services. You must promptly update any information that becomes inaccurate or outdated.

4.2 Legal Compliance

You agree to comply with all applicable laws, regulations, and industry standards in your jurisdiction, including but not limited to:

  • Anti-money laundering regulations
  • Property disclosure requirements
  • Tax obligations
  • Foreign investment regulations
  • Consumer protection laws

4.3 Documentation

You agree to provide all necessary documentation for property transactions, including but not limited to:

  • Valid identification documents
  • Proof of income and financial capacity
  • Property ownership documents
  • Required permits and approvals
  • Insurance documentation

4.4 Communication

You agree to maintain open and honest communication throughout any transaction. You must promptly respond to reasonable requests for information and attend scheduled appointments and meetings.

4.5 Exclusive Representation

If you enter into an exclusive representation agreement with Arabian Reverie, you agree not to engage other real estate agents or brokers for the same property or transaction during the exclusivity period.

5. Property Transactions

5.1 Role as Intermediary

Arabian Reverie acts as an intermediary between buyers and sellers, landlords and tenants. We facilitate transactions but are not party to the underlying property agreements unless specifically stated otherwise.

5.2 Property Information

While we strive to provide accurate property information, we rely on information provided by property owners, developers, and third parties. We recommend that all buyers and tenants:

  • Conduct independent property inspections
  • Verify all property details and specifications
  • Review all legal documentation
  • Obtain professional advice where necessary

5.3 Due Diligence

You are responsible for conducting your own due diligence on any property transaction, including but not limited to:

  • Property title verification
  • Zoning and planning restrictions
  • Property condition assessment
  • Market value analysis
  • Legal and regulatory compliance

5.4 Transaction Completion

All property transactions are subject to contract and completion of legal requirements. Arabian Reverie's obligations are fulfilled upon successful completion of the transaction or termination of the engagement as agreed.

5.5 Off-Plan Properties

For off-plan property transactions, additional terms may apply including construction timelines, specification changes, and developer guarantees. All off-plan purchases are subject to developer terms and conditions.

6. Fees and Payments

6.1 Service Fees

Our fees are clearly outlined in our service agreements and may include:

  • Sales commission (typically paid by the seller)
  • Rental commission (typically paid by the landlord)
  • Property management fees
  • Consultation and advisory fees
  • Valuation and appraisal fees

6.2 Payment Terms

Unless otherwise agreed in writing:

  • Commission fees are due upon successful completion of transactions
  • Consultation fees are payable in advance or as agreed
  • Property management fees are payable monthly in advance
  • All fees are exclusive of applicable taxes unless stated otherwise

6.3 Currency and Taxes

All fees are quoted in UAE Dirhams (AED) unless otherwise specified. You are responsible for any applicable taxes, including but not limited to VAT, withholding tax, and transfer taxes.

6.4 Refund Policy

Fees paid for completed services are generally non-refundable. Refunds may be considered in exceptional circumstances at our sole discretion and subject to deduction of costs incurred.

6.5 Late Payments

Late payments may incur interest charges at the rate of 1.5% per month or the maximum rate permitted by law, whichever is lower. We reserve the right to suspend services for overdue accounts.

7. Intellectual Property

7.1 Our Intellectual Property

All content, trademarks, service marks, logos, and intellectual property on our website and in our services are owned by or licensed to Arabian Reverie. This includes but is not limited to:

  • Website design and functionality
  • Marketing materials and brochures
  • Property listings and descriptions
  • Photographs and virtual tours
  • Market reports and analysis
  • Software and applications

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our services for their intended purpose. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks or branding without authorization
  • Reverse engineer or attempt to extract source code
  • Create derivative works based on our content
  • Use our content for commercial purposes without consent

7.3 User-Generated Content

By submitting content to our services (reviews, comments, property information), you grant us a worldwide, royalty-free license to use, modify, and display such content in connection with our services.

7.4 Copyright Infringement

We respect intellectual property rights and expect users to do the same. If you believe your copyright has been infringed, please contact us with detailed information about the alleged infringement.

8. Prohibited Uses

You agree not to use our services for any of the following prohibited purposes:

8.1 Illegal Activities

  • Money laundering or terrorist financing
  • Fraud or misrepresentation
  • Tax evasion or avoidance schemes
  • Violation of sanctions or embargo laws
  • Any other illegal or criminal activities

8.2 Harmful Activities

  • Transmitting viruses, malware, or harmful code
  • Attempting to gain unauthorized access to our systems
  • Interfering with the proper functioning of our services
  • Collecting user information without consent
  • Spamming or sending unsolicited communications

8.3 Misuse of Services

  • Providing false or misleading information
  • Impersonating another person or entity
  • Using our services to compete with our business
  • Scraping or automated data collection
  • Circumventing security measures

8.4 Consequences of Prohibited Use

Violation of these prohibited uses may result in immediate termination of services, legal action, and reporting to relevant authorities. You will be liable for any damages resulting from prohibited use.

9. Disclaimers

9.1 Service Availability

Our services are provided "as is" and "as available." We do not guarantee uninterrupted or error-free service. We may suspend or modify services for maintenance, updates, or other operational reasons.

9.2 Information Accuracy

While we strive to provide accurate information, we make no warranties regarding the completeness, accuracy, or reliability of any information provided through our services. Property information, market data, and valuations are estimates and should not be solely relied upon for decision-making.

9.3 Investment Advice

Any information provided regarding property investments is for general guidance only and does not constitute financial or investment advice. You should consult with qualified professionals before making investment decisions.

9.4 Third-Party Content

We are not responsible for the accuracy, legality, or appropriateness of content provided by third parties, including property developers, other agents, or service providers.

9.5 Market Conditions

Real estate markets are subject to fluctuation and external factors beyond our control. We make no guarantees regarding property values, rental yields, or market performance.

10. Limitation of Liability

10.1 General Limitations

To the maximum extent permitted by law, Arabian Reverie's total liability for any claims arising from or related to these Terms or our services shall not exceed the total fees paid by you to us in the 12 months preceding the claim.

10.2 Excluded Damages

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Lost profits or business opportunities
  • Loss of data or information
  • Business interruption
  • Loss of goodwill or reputation
  • Property value fluctuations

10.3 Jurisdictional Variations

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10.4 Time Limitations

Any claims against Arabian Reverie must be brought within one (1) year of the date the cause of action arose, or such shorter period as may be required by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Arabian Reverie, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Any information or content you provide to us
  • Your property transactions or related activities
  • Any third-party claims related to your use of our services

This indemnification obligation shall survive termination of these Terms and your use of our services.

12. Termination

12.1 Termination by You

You may terminate your use of our services at any time by providing written notice. Termination does not relieve you of obligations for services already provided or fees already incurred.

12.2 Termination by Us

We may terminate or suspend your access to our services immediately, without prior notice, for any reason including but not limited to:

  • Violation of these Terms
  • Illegal or fraudulent activity
  • Non-payment of fees
  • Breach of professional conduct
  • Discontinuation of services

12.3 Effect of Termination

Upon termination:

  • Your right to use our services ceases immediately
  • We may delete your account and associated data
  • Outstanding obligations remain in effect
  • Confidentiality obligations continue
  • Ongoing transactions may be completed at our discretion

13. Governing Law

13.1 Primary Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates and the Emirate of Dubai, without regard to conflict of law principles.

13.2 International Users

For users located in other jurisdictions, the following additional provisions may apply:

United Kingdom

UK consumer protection laws may apply to UK residents. Nothing in these Terms affects your statutory rights as a UK consumer.

European Union

EU consumer protection and data protection laws apply to EU residents. These Terms comply with applicable EU regulations.

Australia

Australian Consumer Law applies to Australian residents. Our services comply with Australian consumer protection requirements.

United States

US federal and state laws may apply to US residents. Real estate transactions involving US persons are subject to additional compliance requirements.

14. Dispute Resolution

14.1 Negotiation

In the event of any dispute arising from these Terms or our services, the parties agree to first attempt to resolve the dispute through good faith negotiation.

14.2 Mediation

If negotiation fails, disputes shall be submitted to mediation before a mutually agreed mediator in Dubai, UAE, in accordance with the mediation rules of the Dubai International Arbitration Centre (DIAC).

14.3 Arbitration

If mediation fails, any remaining disputes shall be finally resolved by arbitration under the DIAC Arbitration Rules. The arbitration shall be conducted in English in Dubai, UAE, by a single arbitrator appointed in accordance with DIAC rules.

14.4 Exceptions

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or confidential information.

14.5 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms that is due to fire, flood, earthquake, pandemic, government action, war, terrorism, labor disputes, or other causes beyond the reasonable control of such party.

The affected party must promptly notify the other party of any force majeure event and use reasonable efforts to minimize the impact and duration of such event.

If a force majeure event continues for more than 90 days, either party may terminate the affected services upon written notice.

16. Modifications

16.1 Right to Modify

We reserve the right to modify these Terms at any time. Modifications will be effective immediately upon posting on our website or as otherwise communicated to you.

16.2 Notice of Changes

We will provide reasonable notice of material changes to these Terms through our website, email, or other appropriate means. Your continued use of our services after such notice constitutes acceptance of the modified Terms.

16.3 Rejection of Changes

If you do not agree to modified Terms, you must discontinue use of our services. Continued use after modification constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole.

Any unenforceable or invalid provision shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect.

If possible, the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

Important Notice

These Terms and Conditions constitute the entire agreement between you and Arabian Reverie Premier Realty. By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
